Terms of Use for Electrum ETH

These Terms of Use (“Terms”) govern your use of the Electrum ETH wallet and related websites. By installing, accessing, or using Electrum ETH, you agree to these Terms. If you do not agree, you must not use the wallet or associated services.

Electrum ETH is a non-custodial wallet. You are responsible for your keys and funds.
We do not provide investment, trading, or tax advice.
Using blockchain technology involves risk, including loss of digital assets.

What these Terms cover

  • How you may use the Electrum ETH software and site.
  • Your responsibilities as a non-custodial wallet user.
  • Acceptable and prohibited uses of the wallet.

1. Scope and acceptance of Terms

These Terms apply to your use of the Electrum ETH desktop wallet, documentation, websites, and any other materials we provide in connection with the wallet (collectively, the “Services”).

By using the Services, you represent and agree that:

  • You have read, understood, and accept these Terms and our Privacy Policy.
  • You will use the Services only in compliance with applicable laws and regulations.
  • If you use Electrum ETH on behalf of another person or legal entity, you have authority to bind that person or entity to these Terms.

2. Using Electrum ETH

Electrum ETH is a non-custodial Ethereum wallet with routing features across Ethereum and selected L2 networks. It is designed to help you prepare and broadcast transactions, but it does not control the underlying networks or smart contracts you interact with.

You understand and agree that:

  • Electrum ETH is not a bank, broker, exchange, custodian, or payment service provider.
  • The Services give you tools to interact with public blockchains, but do not execute transactions on your behalf.
  • You are solely responsible for choosing what to sign, which contracts to interact with, and which networks to use.

3. Eligibility and compliance

To use the Services, you must:

  • be at least the age of majority in your jurisdiction, and
  • have the full legal capacity to enter into binding contracts in your jurisdiction.

You may not use the Services if doing so would violate any law or regulation that applies to you, including restrictions related to sanctions, anti-money laundering, or financial services.

4. Non-custodial nature and your responsibilities

Electrum ETH is non-custodial. The software helps you generate and manage keys and sign transactions locally on your device.

What we do not control

  • Your private keys, seed phrase, or recovery words.
  • Your on-chain balances or transfers.
  • The performance, security, or availability of networks.
  • Smart contracts, protocols, or third-party services you choose to interact with.

Your responsibilities

  • Safely storing your seed phrase, private keys, and backups.
  • Verifying transaction details, routes, and contract addresses before signing.
  • Ensuring you understand the risks of using blockchain technology.
  • Keeping your devices and operating systems secure and up to date.

If you lose access to your wallet or seed phrase, we cannot recover your funds for you.

5. Acceptable use

You agree to use the Services only for lawful purposes and in a manner that does not harm Electrum ETH, other users, or third parties.

You may not use the Services to:

  • Violate any applicable law, regulation, or third-party rights.
  • Engage in fraud, money laundering, terrorist financing, or other illegal activities.
  • Interfere with or disrupt the normal operation of the Services or underlying infrastructure.
  • Attempt to circumvent security or technical protections in the wallet, associated infrastructure, or third-party services.
  • Reverse engineer, decompile, or otherwise attempt to derive the source code of proprietary components, except where permitted by applicable law or open-source licenses.

6. License to use the software and intellectual property

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download, install, and use the Electrum ETH wallet solely for your own lawful purposes.

Ownership

As between you and us, we (and our contributors or licensors) retain all rights, title, and interest in and to the Services, including all software, designs, logos, and associated intellectual property, except where otherwise stated in applicable open-source licenses.

Open-source components

Electrum ETH may include or depend on third-party open-source components. Those components are provided under their own licenses. To the extent of any conflict between these Terms and an applicable open-source license for such components, that open-source license governs your use of those components.

7. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory.

We do not guarantee

  • That the Services will be uninterrupted, error-free, or secure.
  • That routing suggestions will always be optimal, successful, or cheaper than alternatives.
  • That any network, protocol, or smart contract you use via Electrum ETH is safe, reliable, or free of vulnerabilities.
  • Any specific outcome, profit, or performance of your use of digital assets.

No financial or investment advice

Information visible in the wallet (including fee estimates, routes, token balances, and other metrics) is provided for operational purposes and convenience only. It does not constitute financial, investment, legal, or tax advice. You should conduct your own research and consult professional advisors where appropriate.

8. Limitation of liability

To the maximum extent permitted by law, in no event shall Electrum ETH, its contributors, maintainers, or affiliates be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages; or
  • Any loss of profits, revenue, goodwill, data, or digital assets, arising out of or in connection with your use of the Services.

Without limiting the above, we are not liable for damages resulting from:

  • Loss of seed phrases, private keys, or recovery data.
  • Malicious software, phishing, or other attacks on your device or networks.
  • Failures or behaviour of third-party services, networks, or smart contracts.
  • Your decisions in managing or transferring digital assets, including the use of suggested routes.

Where our liability cannot be excluded but may be limited, our aggregate liability to you for all claims arising out of or relating to the Services or these Terms will not exceed the amount you paid (if any) for the use of the Services, or the minimum amount permitted by law if higher.

9. Changes to the Services and these Terms

We may modify, suspend, or discontinue parts of the Services at any time, for example to improve functionality, address security issues, or comply with legal requirements.

We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, provide additional notice (for example, in release notes or on the website).

If you continue to use the Services after changes to the Terms take effect, you will be deemed to have accepted the updated Terms. If you do not agree, you must stop using the Services and uninstall the wallet.

10. Term and termination

These Terms apply to you from the moment you first use the Services and continue until you stop using them or they are terminated by us.

We may suspend or terminate your access to certain Services or infrastructure (for example, nodes or routing services we operate) if we reasonably believe that:

  • You have materially breached these Terms; or
  • Your use presents a security, legal, or other risk.

You may stop using the Services at any time by uninstalling the wallet and ceasing to access our websites. Termination does not affect any rights or obligations that have already accrued.

11. Governing law and dispute resolution

These Terms and any dispute arising out of or in connection with them, or with your use of the Services, will be governed by applicable laws, without regard to conflict-of-law principles that would result in the application of the laws of another jurisdiction.

Where local law permits, disputes should first be raised with us using the contact channels below so we can attempt to resolve them informally. If a dispute cannot be resolved informally, it will be submitted to the competent courts in a jurisdiction that has a sufficient connection to your use of the Services or to the maintainers of Electrum ETH, subject to any applicable mandatory consumer protection rules.

12. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision under these Terms is not a waiver of that right or provision. You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign these Terms in connection with a reorganisation, merger, or similar event.
